Moak, civil engineer for the operations division of the Fort Worth District of the Corps of Engineers, disclosed last week. Although the lake will fall under the jurisdiction of the Corps of Engineers under the terms of "Section 404" as ordered by a federal court last year, the day-to-day handling of permits for structures along the banks of the lake and the removal or placing of fill material around the lake remains, for the most part, the respons- ibility of the Tarrant County Water Disrict No. 1. Permits have always been required for any type of contruction in or around the lake that came below the 325 foot contour. Harold E. Johnson, general superin- tendent of Cedar Creek Lake, said. Only when the lake is distrubed or retaining walls are built that go below the 322-foot contour is a Corps of Engineers permit required, Monk and Johnson explained. Although malay residents of the Cedar Creek Lake are not aware of it, permits have always been required. En- forcement of the permit requirement had been lax until last year, when add- itional help was provided for policing the lake, Johnson said. "One thing I want to make clear," Moak said, "The Corps of Engineers is not going to take over the operations and maintenance of Cedar Creek Lake." Tarrant County Water Board owns the land around the lake up to the 325 foot contour, three feet above the top of the lake's spillway. Any fixed construction on the lake's surface, retaining walls, or filling work done around the lake requires a permit, issued free by the such as cultivating land, is ex- cluded for permit require- ments. "All fill material is a pollutant," Moak said. "And any filling operation below the 322 feet requires a permit from the district office of the Corps of Engineers," he said. Only one permit in 300, based on past experience, will require a Corps of Engineers permit however, Johnson said. Moak said that rumors had been circulating in the area that the Corps of Engineers was taking over the operation of the lake. He said this is absolutely untrue. In the rare cases where a Corps of Engineers permit is required, the application and approval of the permit could be time-consuming, Moak said. A minimum of 90 to 120 days is required, even in cases where there js no opposition to the proposed work. Should a public hear- ing be required, the application could take up to a year and a half. And there is a charge for permits from the Corps of Engineers--s10 if less than 2,500 cubic yards of fill is . disturbed, and $100 if more than that amount. In all cases, the initial application for a permit begins at the Tarrant County Water Board's offices north of Trinidad. If the project doesn't fall under Corps of Engineers require- ments for a permit, the Water Board issues the free permit and work can proceed If the project falls under Corps of Engineers require- ments for a oermit, the ments for a permit, the Tarrant County Water Board issues a permit con- tingent on Corps of Engi- neers approval and the per- son is sent to the district engineer's office in Fort Worth. The permit procedure re- quires public notice, via letters to newspapers, adjacent property owners, and all state and federal agencies who might have an interest in the work. Thirty days are then allowed for comments from the general public and other agencies. If the district engineer deems it necessary, on the basis of information suhtted,  he can call for a publiehearlhg: it also takes 15 days to compile an environmental impact assessment, using Corps of Engineers personnel. At the end of the 30-day period, the Corps of Engineers personnel write up a statement of findings, and on the basis of this statement, the district engineer either issues a permit or denies a permit. The law provides no appeal procedure if the permit is turned down. the district engineer's ruling is final. Based onqpermits issued last year, according to Johnson, only developers have fallen under the Corps of Engineers jurisdiction. "The major effect all this has on work around the lake is the time involved in getting a permit when the Corps of Engineers becomes involved," Moak said. "However, the Environmen- tal Protection Agency must be notified before a permit is issued, and the regional administrator for EPA does have the power to nullify a permit, Moak said. The phased program under which the Corps of Engineers became involved with Cedar Creek Lake will be expanded in 1977, when the Corps also takes over all tributaries to Cedar Creek Lake whose flow exceeds five cubic feet per second normal flow. That could include Kings Creek, Lacey Creek. Prairie Creek, Twin Creeks North and South. Lynn Creek, Clear Creek and Caney Creek. Effective date for that is July 1, 1977, and the normal flow of the tributaries come under the Corp's eye. The Water Board and the Corps of Engineers are not involved with recreation on Cedar Creek Lake. This falls under the care of the Texas Parks and Wildlife Depart- ment. Pillings used for piers of decks, as long as they are not next to each other to form a wall, are not under the provisions of the Corps of Engineers. For instance, you could build a boat dock with a simple permit from the Tarrant County Water Board, even though tim pilings driven to support it went below the 322-foot level set by the Corps of Engineers. All material used in construction or for retaining walls and the like must be permanent or semi- permanent, .Iohnson said. He specifically mention, pressure-treated lumber of steal.
