Goetze by assignment duly recorded in Vol 166, page 629 Deed Records of Hendersan County, Texas, to which reference is hereby made; and WHEREA.S, said note for $2250.00 due November 1, 1931, has' not been paid, default has been made in the payment of same by reas'on whereof the owner and holder of said note to-wit, FhUi.p O. Goetze has exercised his option and has declared the same due and payable at once; and WHEREAS, Andrew Kingkade, trustee named in said Deed of Trus has been requested to perform the duties' of trustee under said instru- ment and make sale of said premises and carry out the terms of said trust, but has refused and failed to act and has' resigned said trusteeship and designated and appointed me, Jno. W. Eas~cerwood, as substitute trustee under the terms and ~conditions of s~id instrument and Philip O. Goetze, the owner and holder af said indebtedness has requested me, Jno. W. Tanner and wife, Izzie Tanner, executed a renewal of the indebtedness, evidenced by the above mentioned $1900.00 note to Mrs. Louise M. Eastabrook which said renewal is duly recorded in Vol 151 page 252 Deed Records of Henderson county, Texas, to which reference is hereby made for a des'cr~ptian of the provis~ons of said instrument, and WHEREAS, default has been made in the payment of interest which was due January 1, 1931 in the sum of $133.00; and WHEREAS, Andrew Kingkade, trustee named in said Deed of-Trust has' been requested to perform the duties of said trustee and make sale of said premises and carry out the terms of said trust, but has refused and failed to act and has res'igned said trusteeship and designated and appointed me, Jno. W. Easterwood, Subs'titute Trustee, by written instrument and Mrs. Louise M. Eas~abrook, the owner and holder of said indebtedness, because of the failure to pay said $133.00 when due has exercised the option contained in said Deed of Trust and has declared all of said indebtednes's, due and payable at once and requested me, the said Jno.
